TERMS AND CONDITIONS FOR Spacemesh Rewards Tracker
1. Acceptance of Terms:
By downloading, installing, or using the Spacemesh Rewards Tracker (“the App”), you signify your agreement to these terms and conditions (“Terms”). If you do not agree to these Terms, you must not download, install, or use the App.
2. License to Use:
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes only.
3. User Responsibility:
You acknowledge that you use the App and the data provided therein at your own risk. It is your responsibility to evaluate the accuracy, completeness, or usefulness of any information or content available through the App.
4. Limitation of Liability for Incorrect Data:
a. While we make efforts to ensure the accuracy of data and content provided by the App, we do not guarantee its correctness, timeliness, or completeness.
b. The App is delivered “AS IS” without any warranties, express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.
c. Swarmbit, along with its affiliates, agents, directors, employees, suppliers, or licensors, shall in no event be liable for any damages, losses, or liabilities, including but not limited to direct, indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or in connection with the use of, or inability to use, this App.
d. Specifically, in no circumstance shall Swarmbit be liable to pay any damages, whether monetary or otherwise, for any incorrect data served by the App.
5. Modifications and Updates:
We reserve the right to modify, suspend, or discontinue the App, temporarily or permanently, with or without notice, at our sole discretion.
6. Termination of Access:
We may, at our sole discretion, terminate or suspend your access to all or part of the App with or without notice and for any reason, including, without limitation, breach of these Terms.
7. Indemnification:
You agree to defend, indemnify, and hold harmless Swarmbit and its subsidiaries, agents, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of your use and access of the App or breach of these Terms.
8. Severability:
If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the invalidity or unenforceability of such provision shall not affect the validity or enforceability of the remaining provisions of these Terms, which shall remain in full force and effect.
9. Analytics Data Collection:
a. The App uses analytics tools and technologies to collect and use certain non-personal data, including but not limited to unique device identifiers, IP address, geographic location, usage data, session length, and other similar information. This data is used to improve the App’s functionality, user experience, and to understand user behavior.
b. All analytics data is aggregated and cannot be used to identify individual users. By accepting these Terms, you consent to the collection and use of this information, as described herein.
10. Advertisements:
a. The App may include advertisements, which could be related to content within the App, queries made through the App, or other information. The types and extent of advertising in the App are subject to change.
b. In consideration for Swarmbit granting you access to and use of the App, you agree that Swarmbit and its third-party providers and partners may place such advertising in the App or in relation to the content displayed within the App.
c. The App may integrate third-party advertisement serving technologies which collect information for ad targeting and measurement. This may include information such as the number of views, clicks, and interactions with these advertisements. The collection and use of this information will be in accordance with the privacy policies of the respective third-party providers.
d. The App integrates appodeal ads. Appodeal ads might collect IP address and device id information. Please check Appodeal privacy policy.
e. Swarmbit does not endorse any products, services, or companies displayed in the advertisements in the App.
